O-1 비자 / 신분
미국의 체류신분 비자 (NONIMMIGRANT VISA)로 뛰어난 능력 또는 업적을 가진 개인이 해당된다.
[ 종 류 ]
1. O-1A : sciences, education, business, or athletics 분야에 뛰어난 능력보유자
2. O-1B : Arts 분야의 뛰어난 능력보유자, Motion Picture or Television 분야에서의 뛰어난 업적이 있는경우
3. O - 2 : O- 1 과 동반하는 Artist 또는 Athlete 분야의 개인이, 특별한 이벤트와 Performance를 돕기위한
개인이어야 하며, O-1A의 활동의 통합적인 활동이 되어야 한다. O-1B 와 동반하는 O-2의 경우는, O-1B의 작품 창출에 필수적인 존재이어야 한다.
4. O - 3 : O-1 과 O-2의 동반가족 (배우자 및 21세미만 자녀)
[ 이민국이 규정한 일반적인 자격요건 ]
The beneficiary must demonstrate extraordinary ability by sustained national or international acclaim and
must be coming temporarily to the United States to continue work in the area of extraordinary ability.
Extraordinary ability in the fields of science, education, business or athletics means a level of expertise
indicating that the person is one of the small percentage who has risen to the very top of the field of
endeavor.
Extraordinary ability in the field of arts means distinction. Distinction means a high level of achievement
in the field of the arts evidenced by a degree of skill and recognition substantially above that ordinarily
encountered to the extent that a person described as prominent is renowned, leading, or well-known in
the field of arts.
To qualify for an O1 visa in the motion picture or television industry, the beneficiary must demonstrate
extraordinary achievement evidenced by a degree of skill and recognition significantly above that
ordinarily encountered to the extent the person is recognized as outstanding, notable or leading in the
motion picture and/or television field.

처음 3년, 그이후 필요성이 인정될 경우, 1년씩 체류 연장이 가능하다.
[ O - 1A 의 입증기준 ]
노벨상같이 국제적으로 인정된 수상자나, 다음중 세가지를 입증하여야 한다.
1. Receipt of nationally or internationally recognized prizes or awards for excellence in the field of endeavor
2. Membership in associations in the field for which classification is sought which require outstanding
achievements, as judged by recognized national or international experts in the field
3. Published material in professional or major trade publications, newspapers or other major media about
the beneficiary and the beneficiary's work in the field for which classification is sought
4. Original scientific, scholarly, or business-related contributions of major significance in the field
5. Authorship of scholarly articles in professional journals or other major media in the field for which
classification is sought A high salary or other remuneration for services as evidenced by contracts or
other reliable evidence
6. Participation on a panel, or individually, as a judge of the work of others in the same or in a field of
specialization allied to that field for which classification is sought
7. Employment in a critical or essential capacity for organizations and establishments that have a
distinguished reputation

Academy Award, Emmy, Grammy or Director's Guild Award와 같은 명성이 있는 상을 받았거나, 후보로 지명
된 증거 또는 다음중 3가지 이상이 해당되면 된다.
1. Performed and will perform services as a lead or starring participant in productions or events which
have a distinguished reputation as evidenced by critical reviews, advertisements, publicity releases,
publications, contracts or endorsements
2. Achieved national or international recognition for achievements, as shown by critical reviews or other
published materials by or about the beneficiary in major newspapers, trade journals, magazines, or other
publications
3. Performed and will perform in a lead, starring, or critical role for organizations and establishments that
have a distinguished reputation as evidenced by articles in newspapers, trade journals, publications, or
testimonials.
4. A record of major commercial or critically acclaimed successes, as shown by such indicators as title,
rating or standing in the field, box office receipts, motion picture or television ratings and other
occupational achievements reported in trade journals, major newspapers or other publications
5. Received significant recognition for achievements from organizations, critics, government agencies or
other recognized experts in the field in which the beneficiary is engaged, with the testimonials clearly
indicating the author's authority, expertise and knowledge of the beneficiary's achievements
6. A high salary or other substantial remuneration for services in relation to others in the field, as shown by
contracts or other reliable evidence If the above standards do not readily apply to the beneficiary's
occupation in the arts, the petitioner may submit comparable evidence in order to establish eligibility
(this exception does not apply to the motion picture or television industry).
